1. Agreement

These Terms of Service ("Terms") form a binding contract between you and MG MAGNIFIC GAMES GmbH ("Magnific Games", "we", "us"), a company registered in Berlin, Germany. They govern your access to and use of the War Alliance mobile game and any related websites, software, updates, and services (the "Service").

By downloading, installing, or using the Service, you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

We may update these Terms from time to time. Material changes will be communicated in-game and on our website, and where legally required we will seek your renewed acceptance before they take effect.

2. Eligibility

War Alliance is intended for players aged 13 and over. We do not refuse access on age grounds.

We do, however, need to know whether you are an adult or a minor so that we can apply age-appropriate processing under GDPR Art. 8, the EU Digital Services Act Art. 28, COPPA, and similar laws. On first launch we determine your age band using your device's platform age signal where available (Google Play Age Signals on Android, Declared Age Range on iOS 26 or later) or, where no platform signal is available, a short in-app question. We do not store your date of birth. Further detail is in our Privacy Policy §5.

Accuracy. You agree to provide accurate information where we ask for it. If we determine that the age information used to set your processing posture was inaccurate, we may update that posture. We will not terminate your account, refuse you service, or delete your data solely on the basis of an age-information correction.

Capacity. If you are under the age of legal majority in your country of residence, these Terms must be reviewed and accepted on your behalf by your parent or legal guardian, who is responsible for your use of the Service. We ask parents and guardians to read these Terms and our Privacy Policy — in particular §5 (age determination) and §10 (children and teens) — and to supervise their child's use of the Service. We do not operate a verifiable parental-consent process; instead, as described in Privacy Policy §10, we restrict how we process a minor's personal data to what is necessary to provide the Service.

Restrictions for minors. Where we determine that you are a minor, some Service features may be restricted or unavailable. In particular, for players we determine to be young children (under 13), community features may be disabled and certain display elements may be anonymized. See Privacy Policy §10.

3. Accounts

You create an account by starting the Service. You may link the account to one or more third-party identity providers (Google, Apple, Facebook, Microsoft, Google Play Games, Apple Game Center). The rules of those providers apply in addition to these Terms.

You are responsible for the security of any login credentials and for activity under your account. Notify feedback@war-alliance.com if you suspect unauthorized access.

You may stop using the Service and delete your account at any time through the in-game Options menu or by contacting support. Deletion removes the account and most associated personal data; see the Privacy Policy for the retention schedule and limits.

If you have not played for an extended period, your account has no purchase history, and your in-game progression is below a basic threshold we set, we may deactivate and eventually delete the account, with reasonable advance notice where practicable.

4. License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial enjoyment. All other rights are reserved.

In particular, you may not: sell, transfer, or sub-license any part of the Service; modify, adapt, reverse engineer, decompile, or disassemble the Service except to the extent expressly permitted by mandatory law; remove proprietary notices, trademarks, or labels; or use the Service in a way that competes with us. This license does not affect any statutory rights you may have as a consumer under applicable mandatory law.

We may update, modify, suspend, or discontinue the Service or any feature at any time. Where required by law (including the EU Digital Content Directive 2019/770), we will give advance notice of material changes. We will not make changes that materially reduce the functionality of paid content you have already purchased unless required for legal, security, or technical reasons, or where compensation is offered in line with EU consumer law.

5. User conduct

You agree not to:

  • Use cheats, exploits, bots, hacks, automation, modifications, or emulators to interfere with the Service or fair competition.
  • Harass, threaten, defame, or harm other users.
  • Post content that is unlawful, obscene, sexually explicit, hateful, discriminatory, or that incites violence.
  • Post or distribute child sexual abuse material — such content will be reported to law-enforcement authorities and to the INHOPE hotline where applicable.
  • Impersonate another person, including Magnific Games staff.
  • Post others' private information, identification documents, or financial details, or solicit any of those from other users.
  • Post spam, chain messages, advertising, or pyramid schemes.
  • Circumvent our age-determination flow or account-suspension controls.
  • Violate applicable export-control, sanctions, anti-money-laundering, or competition law.

Chat and user content. You are solely responsible for everything you post through the Service. By posting, you grant us a worldwide, royalty-free, non-exclusive license to host, store, transmit, display, and moderate your content solely to operate and secure the Service. You retain ownership.

Moderation. We use automated filters to review chat messages and display names at the time of submission, and we may reject or alter them. We do not monitor communications in real time and do not guarantee that every inappropriate message, name, or behaviour is detected. We may review, moderate, and remove content at our discretion.

Reporting. You can report inappropriate behaviour or content to feedback@war-alliance.com. Where we take an action that affects your account, we will provide a statement of reasons consistent with EU Digital Services Act Art. 17 and you may appeal as set out in §8.

Your responsibility for claims. To the extent permitted by mandatory law, you are responsible for third-party claims — and our reasonable, directly related costs — arising from content you post through the Service or from your breach of these Terms or of applicable law. This does not apply to the extent the claim results from our own act or omission, and nothing in this paragraph limits or excludes your statutory rights as a consumer under mandatory law (including §307 BGB).

6. Purchases and virtual items

In-app purchases give you a limited, personal, non-transferable license to use virtual currencies and virtual items ("Virtual Items"). Virtual Items have no real-world monetary value, cannot be exchanged for money, and cannot be transferred outside the Service.

Payments are processed by the app store you purchased through (Apple App Store, Google Play Store, Microsoft Store). Their terms apply. We do not store your payment-card details.

EU/UK right of withdrawal. Virtual Items are digital content supplied immediately upon your purchase. By completing the purchase you expressly consent to immediate performance and acknowledge that you lose your statutory 14-day right of withdrawal once delivery begins. We will remind you of this at the point of purchase where required.

Refunds. Virtual Items are non-refundable except where mandatory consumer-protection law requires otherwise. Refunds are handled by the app store; refund requests should be directed there. Where we process a refund directly at our discretion, we may revoke the corresponding Virtual Items.

Management of Virtual Items. We may modify, rebalance, expire, or remove Virtual Items, with reasonable notice where practicable. We will exercise this right reasonably and in good faith.

Randomized rewards. Where an offer contains randomized rewards, we publish the drop-rate odds in our help centre, and a help link on the purchase surface opens those odds before you commit to the purchase.

7. Our intellectual property; feedback

The Service and all its content are owned by Magnific Games or its licensors and protected by copyright, trademark, and other intellectual-property laws. "War Alliance", the Magnific Games logo, and associated marks are our trademarks. These Terms do not transfer any ownership to you.

If you send us suggestions or feedback about the Service, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use it for any purpose, without compensation.

8. Suspension, termination, and appeals

We may suspend, terminate, or restrict your access to the Service if we reasonably believe that you have breached these Terms, acted in a way that harms the Service or other users, or that we are required to do so by law. We apply such measures in a diligent, objective, and proportionate manner, calibrated to the severity and frequency of the breach.

When we take a restrictive action (mute, suspension, ban, currency revocation), we will provide you with a statement of reasons consistent with EU Digital Services Act Art. 17, including the facts we relied on, the rule cited, and your right of appeal.

Right of appeal. Contact feedback@war-alliance.com. This is our internal complaint-handling system within the meaning of EU Digital Services Act Art. 20: it is electronic, free of charge, available for at least six months after the decision, and decisions are reviewed by qualified staff rather than solely by automated means. We will respond within a reasonable time. Your access to the courts is unaffected, and EU consumers may also use the EU Online Dispute Resolution platform referenced in §11.

On termination, your license to use the Service ends; Virtual Items that remain are forfeited, subject to mandatory local law. Provisions that by their nature should survive termination (ownership, disclaimers, liability limitation, dispute resolution, governing law) remain in effect.

9. Third-party services

The Service integrates with third-party services — identity providers, analytics/marketing providers, advertising mediation, payment processors, and customer-support platforms — listed in the Privacy Policy §6. Your use of those third-party services is subject to their own terms.

10. Warranties and liability

The Service is provided "as is" and "as available", without warranty of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Our total liability to you for any claim arising from or in connection with the Service is limited to the greater of (a) the amount you paid us in the six months before the claim arose or (b) €100, except where mandatory consumer-protection law in your country of residence requires a different limit, in which case that mandatory limit applies.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for gross negligence, willful misconduct, or fraud, or any liability that cannot be excluded under mandatory consumer-protection law of your country of residence — including consumer warranties under EU, UK, Korean, Japanese, Brazilian, and other applicable regimes.

We are not liable for any delay or failure caused by events beyond our reasonable control.

11. Governing law and disputes

EU, UK, and rest-of-world users (default). These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws rules. If you are a consumer resident in the EU or UK, you benefit from any mandatory provisions of the law of your country of residence that provide a higher level of protection. Disputes are subject to the exclusive jurisdiction of the courts of Berlin, Germany, except that an EU/UK consumer may also bring proceedings in their country of residence, and we may bring proceedings there to enforce our rights.

EU Online Dispute Resolution. The European Commission provides an online dispute-resolution platform at https://ec.europa.eu/consumers/odr. EU consumers may use it as an alternative to court. We are not obliged to participate in a consumer-arbitration-board procedure within the meaning of §36 VSBG.

US residents — arbitration and class-action waiver. If you reside in the United States, you and Magnific Games agree to resolve disputes through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except for small-claims-court matters and claims seeking injunctive or equitable relief for intellectual-property infringement. Class actions are waived. Arbitration will take place in San Francisco, California, or virtually. We will pay arbitration filing, administrative, and arbitrator fees to the extent required by the AAA Consumer Arbitration Rules and applicable consumer-protection law. You may opt out of this arbitration agreement by emailing legal@magnificgames.com within 30 days of your first use of the Service with the subject "ARBITRATION OPT-OUT".

Other jurisdictions. Mandatory local law (e.g. Korea, Japan, Brazil, Turkey) prevails over this section where it conflicts.

12. General

These Terms and our Privacy Policy are the entire agreement between you and us about the Service.

If any provision is held unenforceable, the remaining provisions remain in full force.

You may not assign your rights under these Terms; we may assign ours as part of a corporate reorganization, merger, or sale of assets.

A failure to enforce any right does not waive it.

These Terms are provided in English; translations are for convenience and the English version prevails, except where mandatory local law requires the local-language version to prevail.
